Where next for adult social care law?
Designed to discuss and debate pressing issues within the sector, the first FridayFocus lecture – Where next for adult social care law? – took place in London on 15 July 2011, presented by Frances Patterson QC.
The lecture explores the Law Commission’s final report on the reform of adult social care law, published in May 2011. The recommendations amount to the most far-reaching reform of adult social care law seen for over 60 years. The lecture sets out the structure of the new legal framework with a single adult social care statute and supporting code of practice.

We’ve set them out in 4 parts, so that you can watch them a section at a time, if you wish. Each section is just over 10 minutes long – and the full presentation lasts for approximately 45 minutes.

Where Next for Adult Social Care Law, Part 1
In this first section, Ms Patterson provides an outline of the Commission’s work on the project, including an analysis of existing statutes, comment on the consultation undertaken, and the core structure of their proposals.
Where Next for Adult Social Care Law, Part 2
In this second section, Ms Patterson looks in more detail at the Commission’s final recommendations, including discussion of the wellbeing principle and their thinking on assessments, eligibility and carers’ rights.
Where Next for Adult Social Care Law, Part 3
In this third section, Ms Patterson continues her review of recommendations, focusing on the types and purposes of community care services and their provision, and on a series of safeguarding issues.
Where Next for Adult Social Care Law, Part 4
In this final section, Ms Patterson looks at a number of the Commission’s individual recommendations in more detail, including the need for portable assessments and a duty to cooperate. She also touches on the work of the Dilnot Commission.
About the speaker – Frances Patterson QC
Frances was appointed Public Law Commissioner with effect from 1 January 2010 for a period of five years. She was Head of Kings Chambers in Manchester and Leeds and also Head of the Public Law Department within chambers. In 2008 she was appointed Deputy High Court Judge of the Queen’s Bench Division, authorised to sit in the Administrative Court.
She is a leading practitioner in all aspects of town and country planning, environmental law, compulsory purchase and compensation, highways, education, administrative law and community care law.
